TERMS AND CONDITIONS

Africa Gateway Safaris

Africa Gateway Safaris’ Terms and Conditions explain the rules for booking and taking part in our safari holidays, wildlife experiences, tours, accommodation, transport, and related travel services. They cover quotations, payments, itinerary changes, cancellations, refunds, traveller responsibilities, safety, liability, and dispute resolution. Please read them before confirming a booking.

By requesting a quotation, confirming a booking, or making a payment to Africa Gateway Safaris, you acknowledge that you have read and agreed to these Terms and Conditions, together with the itinerary, quotation, invoice, and any written booking-specific terms provided to you.

We encourage every traveller to read these terms carefully before confirming a booking.

1. Definitions

This section defines the key terms used in these Terms and Conditions, including “Company,” “Client,” “Group Leader,” “Booking,” “Supplier,” and “Itinerary.” These definitions clarify who is covered by the agreement and how important booking terms should be understood when arranging or participating in a safari or other travel service with Africa Gateway Safaris.

For the purposes of these Terms and Conditions:

“Company,” “we,” “us,” or “our” refers to Africa Gateway Safaris.

“Client,” “traveller,” “you,” or “your” refers to any person making, requesting, or participating in a booking.

“Group Leader” refers to the person designated as the main contact for a group booking.

“Booking” or “reservation” refers to a confirmed arrangement for a safari, tour, accommodation, transfer, activity, or other travel service.

“Supplier” refers to an independent third party providing a service, including accommodation providers, airlines, transport operators, guides, activity providers, and other travel businesses.

“Itinerary” refers to the agreed travel programme, including destinations, activities, accommodation, transport, and other services listed in the booking documents.

2. Booking Enquiries and Reservations

This section explains how to plan a safari, accept a quotation, confirm a reservation, provide traveller details, and coordinate group bookings. An enquiry or quotation alone does not guarantee availability. A booking becomes confirmed only after the required acceptance, payment, and written confirmation steps have been completed, subject to any outstanding supplier confirmations.

2.1 Planning your safari

Safari planning helps us understand your preferences and prepare a suitable itinerary and quotation. We may ask about travel dates, interests, budget, accommodation preferences, group size, dietary requirements, and other needs. All quotations depend on the information available at the time and remain subject to supplier availability and confirmation.

Safari planning is a collaborative process. We may communicate with you to understand your travel dates, interests, budget, accommodation preferences, group size, dietary requirements, and other needs before preparing a suitable itinerary and quotation.

Our quotations are based on the information available at the time they are prepared and are subject to availability and confirmation by the relevant suppliers.

2.2 Confirming a booking

A booking is confirmed only after the quotation and itinerary have been accepted in writing, the required deposit or initial payment has been received, and written confirmation has been provided by Africa Gateway Safaris, subject to outstanding supplier confirmations. Any different payment requirements will be communicated before payment.

A booking is considered confirmed when:

You have accepted the quotation and proposed itinerary in writing.

We have received the required deposit or other agreed initial payment.

We have confirmed the booking in writing, subject to any outstanding supplier confirmations.

Where a particular service requires full payment or a different deposit arrangement, the applicable requirement will be communicated before payment.

Submitting an inquiry or receiving a quotation does not, by itself, guarantee availability or constitute a confirmed reservation.

2.3 Booking information

Providing complete and accurate information for every traveller helps us arrange the services correctly. Details may include passport names, travel dates, arrival and departure information, dietary requirements, room preferences, mobility needs, and other relevant details. Inaccurate or incomplete information may cause delays, extra costs, or service limitations.

You are responsible for providing complete and accurate information for every traveller included in the booking. This may include full names as shown on passports, travel dates, arrival and departure details, dietary requirements, room preferences, relevant mobility needs, and other information reasonably necessary to arrange your trip.

Incorrect or incomplete information may result in additional costs, delays, or the inability to provide certain services.

2.4 Group bookings

For group bookings, the Group Leader normally coordinates information and communications for the group. Unless agreed otherwise in writing, the Group Leader is responsible for ensuring that group members understand the booking terms and that payments are made on time. Separate payments may be accepted if agreed in advance.

For group bookings, the Group Leader will normally act as the primary contact and is responsible for coordinating information and communications on behalf of the group.

Unless otherwise agreed in writing, the Group Leader is responsible for ensuring that the group understands the booking terms and that all agreed payments are made on time. We may accept separate payments from individual group members where this has been agreed in advance.

3. Quotations, Prices, and Price Changes

This section explains how Africa Gateway Safaris quotations are priced, how long they remain valid, and when a price may change. Your quotation should identify the currency, inclusions, exclusions, and validity period where applicable. Any permitted adjustment should be explained, handled under the booking agreement, and remain subject to applicable law.

3.1 Quotation validity

Each quotation should state the applicable price, currency, inclusions, exclusions, and validity period where relevant. Before confirmation, prices may change because of supplier availability, seasonal rates, exchange rates, or government fees and taxes. Services are not guaranteed until the relevant reservations have been confirmed.

Each quotation will state its applicable price, currency, inclusions, exclusions, and validity period where applicable. Prices may change before booking confirmation because of supplier availability, seasonal rates, exchange rates, or changes to government fees and taxes.

Services are not guaranteed until the relevant reservations have been confirmed.

3.2 Price guarantee after confirmation

After a booking is confirmed and the required deposit is received, we will make reasonable efforts to honour the agreed price. Adjustments may still be necessary for permitted changes in government charges, supplier prices, fuel costs, exchange rates expressly covered by the quotation, estimated future costs, or material quotation errors. We will explain proposed changes and seek agreement where required.

Once your booking has been confirmed and the required deposit received, we will make reasonable efforts to honour the agreed price. However, adjustments may be necessary in the following circumstances, subject to the booking agreement and applicable law:

Government fees and taxes: Changes to national park fees, conservation charges, levies, taxes, or other mandatory government charges.

Supplier price changes: Changes imposed by accommodation providers, transport operators, airlines, or other suppliers before the relevant service is secured, where permitted under the agreed quotation.

Fuel and transport surcharges: Material increases in fuel or transportation costs passed on by suppliers.

Currency fluctuations: Material exchange-rate changes affecting supplier costs where the quotation expressly allows for such adjustments.

Estimated future costs: Adjustments to clearly identified estimates where final supplier rates were not available when the quotation was prepared.

Material quotation errors: A significant pricing or calculation error in a quotation. We will notify you promptly and discuss an appropriate correction before proceeding.

We will explain any proposed price adjustment and seek your agreement where required. If an acceptable arrangement cannot be reached, the options available will depend on the booking terms, the services already confirmed, and applicable law.

We will not use this section to remove any rights that cannot legally be excluded.

4. Deposits and Payment Terms

This section explains the deposits that may apply to camping, lodge, and tailor-made safaris, when the remaining balance is due, and which payment methods may be accepted. Your quotation or invoice will state the applicable requirements. Use only payment instructions officially provided or confirmed by Africa Gateway Safaris.

4.1 Deposit requirements

The deposit depends on the safari type and the requirements stated in your quotation or invoice. Unless different terms are specified, camping safaris may require 10%, lodge safaris 30%, and tailor-made safaris between 10% and 70%. Some accommodation, permits, flights, special activities, or peak-season bookings may require a higher deposit or full prepayment.

Unless your quotation or invoice specifies different terms, the following deposit schedule may apply:

Camping safaris: A deposit of 10% of the total booking price.

Lodge safaris: A deposit of 30% of the total booking price.

Tailor-made safaris: A deposit between 10% and 70%, depending on the itinerary, supplier requirements, and booking arrangements.

The applicable deposit and due date will be confirmed in your quotation or invoice. Certain accommodation, permits, flights, special activities, or peak-season bookings may require higher deposits or full prepayment.

4.2 Final payment

Unless the invoice states otherwise, the outstanding balance must be paid before departure and by the stated deadline. Payment on arrival is available only when expressly approved by Africa Gateway Safaris in writing, including confirmation of the amount and accepted payment method.

Unless otherwise stated in writing, all outstanding balances must be paid before the tour departure date and by the deadline specified in the invoice.

Where payment on arrival has been expressly approved in writing, the agreed amount and accepted payment method will apply. Payment on arrival should not be assumed unless we have confirmed it.

4.3 Accepted payment methods

Accepted payment methods may include bank transfer, credit or debit card, and approved online payment services. The invoice will provide the relevant instructions. For your security, pay only through channels officially provided or confirmed by Africa Gateway Safaris.

Available payment methods may include bank transfer, credit or debit card, and approved online payment services. We will provide the relevant payment instructions with your invoice.

Payments must be made only through payment channels officially provided or confirmed by Africa Gateway Safaris. Please contact us through our official website if you receive unexpected or suspicious payment instructions.

4.4 Payment confirmation and transaction fees

When requested, provide proof of transfer or payment so we can verify receipt. Any transaction fees, bank charges, card processing fees, or currency conversion costs payable by the client will be disclosed before payment where applicable.

Please send proof of bank transfer or other payment confirmation when requested. We will confirm receipt once the funds have been received and verified.

Any transaction fees, bank transfer charges, card processing fees, or currency conversion costs that are payable by the client will be disclosed before payment where applicable.

4.5 Late or incomplete payments

If a payment is overdue, we may send written notice requesting settlement. If the amount remains unpaid, we may suspend arrangements or cancel affected services in accordance with the booking terms and applicable law. Supplier cancellation charges may apply.

If payment is not received by the agreed deadline, we may provide written notice and request that the outstanding amount be settled. Where payment remains overdue, and subject to the booking terms and applicable law, we may suspend arrangements or cancel affected services. Supplier cancellation charges may apply.

5. Currency

This section explains the currencies that may be used for quotations and payments. Your invoice will identify the agreed currency, which may be USD, EUR, or TZS. Payment should be made in that currency unless Africa Gateway Safaris approves an alternative in writing, including any applicable exchange rate or charges.

Quotations may be issued in the currency stated in your quotation or invoice, which may include United States dollars (USD), euros (EUR), or Tanzanian shillings (TZS).

You must pay in the agreed invoice currency unless we approve an alternative in writing. Where a different currency is accepted, the applicable exchange rate and any associated charges will be communicated where possible.

Cash payments, where permitted, must be agreed in advance and made through an authorized company representative.

6. What Is Included in Your Safari

This section explains which services are included in your safari and which costs may be excluded. Your confirmed quotation, invoice, and itinerary determine the services you have purchased. Depending on the package, accommodation, meals, park fees, transport, guides, transfers, and activities may be included; flights, insurance, tips, personal expenses, and optional activities may not be.

The services included in your booking are those specifically listed in your confirmed quotation, invoice, and itinerary.

Depending on the package, inclusions may cover accommodation, meals, park and conservation fees, safari vehicle and driver-guide services, scheduled transfers, and specified activities.

Unless expressly included in writing, the following may be excluded:

International and domestic flights.

Visas, passport fees, and travel documentation costs.

Travel, medical, evacuation, or cancellation insurance.

Personal expenses, including laundry, souvenirs, and telephone charges.

Tips and gratuities.

Optional excursions or activities.

Additional meals, drinks, or services not specified in the itinerary.

Costs arising from personal itinerary changes, missed departures, or other circumstances attributable to the traveller.

Please review your quotation carefully and ask us to clarify any item before confirming your booking.

7. Changes to the Itinerary

This section explains how itinerary changes may be handled when requested by the client or required by Africa Gateway Safaris. Weather, road conditions, wildlife movements, park rules, safety concerns, and supplier availability can affect safari plans. We will make reasonable efforts to provide suitable alternatives and communicate material changes, subject to the booking agreement and applicable law.

7.1 Changes made by Africa Gateway Safaris

We aim to operate the confirmed itinerary, but weather, roads, wildlife movements, park regulations, supplier availability, and safety concerns may require changes. Where reasonably available, we will seek a suitable alternative of comparable value and quality, notify you of material changes, and seek agreement where required.

We make reasonable efforts to operate the itinerary as confirmed. However, safari travel can be affected by weather, road conditions, wildlife movements, park regulations, supplier availability, safety concerns, and other circumstances beyond our control.

Where a change is necessary, we will endeavor to provide a suitable alternative of comparable value and quality, where reasonably available.

Changes may include adjustments to the order of destinations, accommodation substitutions, transport arrangements, or activity schedules. We will notify you of material changes as soon as reasonably practicable and seek your agreement where required.

If a significant change cannot be resolved satisfactorily, the available options will be determined by the booking terms and applicable law.

7.2 Changes requested by the client

Please contact us as early as possible if you want to change dates, destinations, accommodation, activities, or traveller numbers. Changes depend on availability and may incur supplier penalties, revised prices, or disclosed administrative fees. Removing a service may be treated as cancellation of that service.

If you wish to change confirmed travel dates, destinations, accommodation, activities, or the number of travellers, please contact us as early as possible.

Changes are subject to availability and may result in additional costs, supplier penalties, revised prices, or administrative fees where disclosed and applicable. A request to remove or cancel part of a confirmed booking may be treated as a cancellation of that service.

Additional services may sometimes be added without an amendment fee, but supplier charges and availability will still apply.

7.3 Group itinerary adjustments

For shared group departures with different package options, we may need reasonable changes to activity timing or sequence to coordinate the group. We will endeavour to preserve the agreed destinations, duration, and essential services. Any material reduction in purchased services will be handled under the booking agreement and applicable law.

Where travellers have booked different package options within a shared group departure, reasonable adjustments to the sequence or timing of activities may occasionally be necessary to coordinate the group. We will endeavour to preserve the agreed destinations, duration, and essential services.

Any material reduction in the services purchased will be handled in accordance with the booking agreement and applicable law.

8. Cancellations and Refunds

This section explains how clients can cancel a booking, when refunds or credit notes may be available, and how exceptional circumstances are reviewed. Cancellation requests must be submitted in writing. The applicable outcome depends on the cancellation period, supplier charges, the quotation or invoice, and applicable law; any special cancellation conditions should be disclosed before confirmation.

8.1 Cancellation by the client

Cancellation requests must be sent in writing by the lead traveller or an authorised representative. Unless a different schedule is stated in the quotation or invoice, the proposed cancellation outcomes below apply to eligible payments, subject to non-refundable supplier costs and applicable law.

All cancellation requests must be submitted in writing by the lead traveller or an authorised representative. The date on which we receive the written request will normally be used to determine the applicable cancellation period.

Unless a different written cancellation schedule is provided with your quotation or invoice, the following proposed schedule applies:

Time before tour departureProposed cancellation outcome
45 days or moreRefund of eligible payments, less a 15% administration and processing charge, subject to non-refundable supplier costs and applicable law.
30–44 days50% refund or a 100% credit note for eligible amounts, at the client’s choice, subject to non-refundable supplier costs and applicable law.
15–29 daysNo cash refund; a credit note for eligible amounts may be issued, subject to supplier terms and applicable law.
0–14 daysNo refund or credit is ordinarily available, except where an exception is agreed in writing or required by applicable law.

Important: Certain services, including flights, park permits, special accommodation, and peak-season reservations, may be subject to stricter supplier cancellation conditions. Any applicable special conditions should be disclosed before the booking is confirmed.

Where supplier charges or other deductions apply, we will explain the basis of the calculation. Nothing in this policy excludes any refund or other right that is mandatory under applicable law.

8.2 Credit notes

If a credit note is offered instead of or alongside a refund, its value, validity period, permitted use, transferability, and restrictions will be stated in writing. Credit notes remain subject to the terms provided when issued and any mandatory legal requirements.

Where a credit note is offered, its value, validity period, permitted use, transferability, and any restrictions will be stated in writing. Credit notes are subject to the terms communicated when they are issued and any mandatory legal requirements.

8.3 Medical or exceptional circumstances

If a serious medical issue or another exceptional circumstance requires cancellation, contact us promptly and provide reasonable supporting documentation if requested. We will review the circumstances and supplier policies, but an exception or refund is not guaranteed unless agreed in writing or required by law.

If you need to cancel because of a serious medical or other exceptional circumstance, please contact us promptly and provide reasonable supporting documentation where requested.

We will review the circumstances and applicable supplier policies. An exception or refund is not guaranteed unless agreed in writing or required by law.

8.4 Refund processing

Approved refunds will normally be returned through the original payment method where reasonably possible. Processing time may depend on banks, payment providers, suppliers, and verification requirements. Any deductions will be explained, and refunds will be handled within the agreed period or the period required by applicable law.

Approved refunds will be processed using the original payment method where reasonably possible. Processing times may depend on banks, payment providers, suppliers, and the verification required.

Any applicable deductions will be communicated to the client. Refunds will be handled within the period agreed in writing or required by applicable law.

9. Cancellations or Changes by the Company

This section explains why Africa Gateway Safaris may need to cancel, postpone, or materially change a tour, including safety concerns, supplier failure, government restrictions, extreme weather, or closures. Where reasonably possible, we will offer an alternative arrangement. Refunds and other remedies will follow the booking agreement and applicable law.

In exceptional circumstances, we may need to cancel, postpone, or materially change a tour because of safety concerns, supplier failure, accommodation unavailability, government restrictions, extreme weather, road or park closures, civil unrest, or other circumstances that make the original arrangements impracticable or unsafe.

Where reasonably possible, we will offer an alternative arrangement or revised itinerary. If no suitable alternative can be agreed, refunds or other remedies will be handled in accordance with the booking agreement and applicable law.

We will not be responsible for additional personal expenses, such as independently purchased flights, visas, vaccinations, or other arrangements outside our confirmed services, except where responsibility is imposed by applicable law or expressly agreed in writing.

10. Travel Documents and Entry Requirements

This section explains each traveller’s responsibility to obtain valid passports, visas, permits, and other required travel documents. Entry requirements can vary by nationality and destination, so travellers should verify current rules with official authorities, embassies, consulates, or airlines before departure. General information from Africa Gateway Safaris does not guarantee entry permission.

You are responsible for ensuring that you and every traveller in your party have valid passports, visas, permits, and other documents required for your journey.

You should check current entry requirements with the relevant embassy, consulate, airline, or official government authority before travelling. Passport validity requirements and visa conditions may differ according to nationality and destination.

Africa Gateway Safaris may provide general travel information, but unless expressly agreed otherwise, we do not guarantee that entry permission will be granted. We are not responsible for denied boarding, refused entry, or costs resulting from incomplete or invalid travel documents, except where applicable law provides otherwise.

11. Health, Fitness and Travel Insurance

This section explains traveller responsibilities for assessing health, fitness, mobility, and insurance needs before a safari. Please advise us of relevant dietary requirements, allergies, or mobility limitations that may affect arrangements. We strongly recommend comprehensive travel insurance and advice from a qualified healthcare professional about destination-specific health precautions.

11.1 Health and fitness

Each traveller is responsible for assessing whether planned activities are suitable for their health, fitness, and mobility. Tell us before booking about relevant dietary requirements, mobility limitations, allergies, or other needs that may affect safe arrangements, and inform us of material changes before departure.

You are responsible for assessing whether the activities in your itinerary are suitable for your health, fitness, and mobility.

Please advise us before booking of any relevant dietary requirements, mobility limitations, allergies, or other needs that may affect the safe delivery of the trip. You should also inform us of material changes before departure.

We recommend consulting a qualified healthcare professional or travel health clinic regarding vaccinations, medication, malaria prevention, and other destination-specific health precautions.

11.2 Travel insurance

Comprehensive travel insurance is strongly recommended for every traveller and should be arranged as soon as possible after booking. Where available and appropriate, cover should include medical treatment, evacuation and repatriation, cancellation or interruption, delays, baggage loss or theft, and the activities in your itinerary. Check policy limits and exclusions carefully.

Comprehensive travel insurance is strongly recommended for every traveller and should be arranged as soon as possible after booking.

Your policy should, where available and appropriate, cover medical treatment, emergency evacuation and repatriation, trip cancellation or interruption, delays, baggage loss or theft, and activities included in your itinerary.

You are responsible for checking policy limits, exclusions, and whether the policy covers safari travel and any planned high-risk or adventure activities. Insurance does not replace the need to follow safety instructions.

12. Wildlife, Activities and Safety

This section explains the risks associated with safaris and outdoor activities and the safety instructions travellers must follow. Wildlife encounters, uneven terrain, changing weather, remote locations, and limited medical access are inherent risks. Follow authorised staff instructions, respect wildlife and restricted areas, and understand that sightings of particular animals cannot be guaranteed.

Safaris and outdoor activities involve inherent risks, including uneven terrain, remote locations, changing weather, wildlife encounters, and limited access to medical facilities.

For your safety, you must follow the instructions of your guide, driver, activity leader, accommodation staff, park authorities, and other authorised personnel.

You must not approach, feed, touch, or provoke wild animals, leave designated areas where prohibited, or engage in conduct that places yourself or others at risk.

Wildlife sightings cannot be guaranteed. Animals move freely in their natural habitat, and the Company does not promise sightings of any particular species.

You participate in activities subject to their nature, the relevant safety instructions, the booking terms, and applicable law. Nothing in these Terms and Conditions excludes liability for death, personal injury, fraud, or other matters where exclusion is prohibited by law.

13. Client Conduct and Suitability

This section explains the standards of behaviour expected from all travellers during a safari. Clients must treat guides, staff, other guests, local communities, wildlife, and the environment respectfully and follow reasonable safety instructions. Where conduct creates danger, harassment, damage, or other serious concerns, Africa Gateway Safaris may take reasonable action subject to the booking terms and applicable law.

All travellers are expected to behave respectfully toward guides, staff, other guests, local communities, wildlife, and the natural environment.

We may take reasonable action, including refusing participation in a particular activity or ending arrangements where necessary, if a traveller:

Behaves violently, abusively, unlawfully, or dangerously.

Harasses or threatens another person.

Damages property or wildlife habitats.

Ignores reasonable safety instructions.

Is unable to participate safely in an activity despite reasonable adjustments being considered.

Where arrangements are ended because of a traveller’s conduct, any refund or additional costs will be assessed in accordance with the booking terms and applicable law.

14. Delays, Flights and Transfers

This section explains how transport delays and missed connections may affect a safari and what assistance may be available. Flights, road transfers, ferries, and other services can be disrupted by weather, technical issues, traffic, strikes, or operational problems. Contact us promptly if a delay affects your trip, and allow sufficient time for independently arranged connections.

Flights, road transfers, ferries, and other transport services may be affected by weather, technical problems, operational issues, strikes, traffic, or other events.

We will make reasonable efforts to assist with alternative arrangements where the affected service forms part of your confirmed booking and where alternatives are available.

You are responsible for allowing sufficient time for independently arranged flights and connections. Unless expressly included in your booking, the Company is not responsible for independently purchased airline tickets or other arrangements made outside the confirmed itinerary, subject to applicable law.

If a delay or missed connection affects your safari, contact us as soon as possible so that we can advise on the available options.

15. Third-Party Suppliers and Optional Activities

This section explains the role of independent suppliers and how optional activities are treated under your booking. Hotels, lodges, airlines, transport companies, and activity operators may have their own terms. An optional activity is not included unless it appears in your confirmed itinerary or Africa Gateway Safaris has expressly agreed to arrange it as part of your booking.

Some services may be delivered by independent suppliers, including hotels, lodges, airlines, transport companies, and activity operators.

Where a service is provided by an independent supplier, it may be subject to that supplier’s own terms and conditions. We will explain any material supplier conditions made available to us that apply to your booking.

Optional activities that are not included in your confirmed itinerary may be offered or recommended for your convenience. Unless we have expressly agreed to arrange such an activity as part of your booking, it is not included in our contracted services.

Nothing in this section excludes responsibility that Africa Gateway Safaris may have under applicable law for services it has agreed to provide or arrange.

16. Complaints and Problems During Your Safari

This section explains how to report problems during a safari so that Africa Gateway Safaris has a reasonable opportunity to investigate and address them. Notify your guide, representative, or the Company as soon as practical. If the issue remains unresolved, submit a written complaint with booking details and supporting information after your return.

If a problem arises during your trip, please notify your guide, our representative, or the Company as soon as reasonably possible. Prompt notification gives us the opportunity to investigate and, where practical, correct the problem while you are travelling.

If the issue cannot be resolved during the trip, please submit a written complaint after your return with the relevant booking details and supporting information.

We will review complaints fairly and respond within a reasonable period. Failure to report an issue immediately will not automatically remove any rights you may have under applicable law.

17. Force Majeure and Events Beyond Our Control

This section explains how exceptional events beyond reasonable control may affect a booking. Examples include natural disasters, severe weather, epidemics, war, civil unrest, government restrictions, border closures, and major transport disruptions. We will make reasonable efforts to communicate and explore alternatives; payment, cancellation, refund, and rescheduling outcomes depend on the circumstances, supplier terms, and applicable law.

A force majeure event is an exceptional circumstance beyond a party’s reasonable control that prevents or significantly affects the performance of a booking. Examples may include natural disasters, severe weather, epidemics, war, terrorism, civil unrest, government restrictions, border closures, and major transport or infrastructure disruptions.

Where such an event affects your trip, we will make reasonable efforts to communicate with you and explore practical alternatives.

The consequences for payments, cancellations, refunds, or rescheduling will depend on the circumstances, the relevant supplier conditions, the booking agreement, and applicable law.

18. Liability

This section explains the standard of care Africa Gateway Safaris applies when arranging and delivering agreed services and the limits that may apply under law. We will not exclude or limit liability where doing so would be unlawful, including for non-excludable matters such as certain death or personal injury claims, fraud, or mandatory consumer protections.

Africa Gateway Safaris will exercise reasonable care in arranging and delivering the services it has agreed to provide.

To the extent permitted by applicable law, we are not responsible for losses arising solely from circumstances beyond our reasonable control or from the independent acts or omissions of third parties whose services are not under our control.

We will not exclude or limit liability where doing so would be unlawful, including liability that cannot legally be excluded for death or personal injury caused by negligence, fraud, or other non-excludable matters.

Nothing in these Terms and Conditions affects any mandatory rights or protections available to you under applicable law.

19. Personal Information and Privacy

This section explains how Africa Gateway Safaris may use personal information to respond to enquiries, prepare quotations, manage bookings, process payments, communicate with travellers, and coordinate suppliers. We take reasonable steps to protect information and handle it under applicable data protection requirements and our privacy practices. Contact us through our official website with privacy questions.

20. Website Information and Intellectual Property

This section explains the limits of website and promotional information and the ownership or permitted use of website content. Photographs, wildlife descriptions, sample itineraries, travel times, and accommodation details may be illustrative. Your confirmed booking documents control the specific services purchased, and website text, branding, images, and other content may not be reused commercially without permission unless the law permits it.

We make reasonable efforts to ensure that information on our website, itineraries, and promotional materials is accurate and up to date. However, photographs, wildlife descriptions, sample itineraries, travel times, and accommodation information may be illustrative and may not represent the exact experience available on every departure.

Unless otherwise stated, website text, branding, images, and other content are owned by or used with permission by the relevant rights holder. They may not be copied, republished, or used commercially without prior permission, except as permitted by law.

21. Website Links and External Resources

This section explains that the Africa Gateway Safaris website may link to external websites for convenience or information. We do not control every third-party website and are not responsible for its content, availability, privacy practices, or terms. A link does not necessarily mean that we endorse all statements or services on the linked website.

Our website may contain links to third-party websites for additional information or convenience. We do not control every external website and are not responsible for its content, availability, privacy practices, or terms.

The inclusion of an external link does not necessarily mean that Africa Gateway Safaris endorses every statement or service on that website.

22. Fraudulent Enquiries and Payment Security

This section explains how Africa Gateway Safaris may respond to enquiries or transactions that reasonably appear fraudulent or deceptive. We may decline or suspend suspicious transactions where lawful and reasonably necessary. To protect yourself, verify payment details through an official Company channel and contact us through our published website details if a message or payment request appears suspicious.

We reserve the right to investigate enquiries or transactions that reasonably appear fraudulent, deceptive, or intended to obtain confidential commercial information through misrepresentation.

We may decline or suspend suspicious transactions where reasonably necessary and lawful.

For your protection, do not send payments to an account or recipient unless the payment details have been confirmed through an official Company communication channel. If you suspect that a message or payment request is fraudulent, contact us using the contact information published on our official website.

23. Governing Law and Dispute Resolution

This section identifies the governing law and the process for resolving disputes about these Terms and Conditions or a booking. The agreement is interpreted under the laws of the United Republic of Tanzania, subject to mandatory legal protections. The parties should first try to resolve disputes through good-faith communication, without removing any legal right to approach a competent court or authority.

These Terms and Conditions and any booking agreement will be interpreted in accordance with the laws of the United Republic of Tanzania, subject to any mandatory legal protections that apply to the client.

If a dispute arises, both parties should first make reasonable efforts to resolve it through good-faith communication.

Where the dispute cannot be resolved informally, it may be referred to the competent courts or other dispute-resolution body with jurisdiction under applicable law.

Nothing in this section removes any mandatory right a client may have to bring a claim before a court or authority that is legally entitled to hear it.

24. Amendments to These Terms

This section explains how Africa Gateway Safaris may update these Terms and Conditions to reflect changes in services, operations, or legal requirements. The version agreed at booking will generally apply to that confirmed booking unless later changes are accepted in writing or required by law. Material changes to an existing booking will be communicated where reasonably practicable.

Africa Gateway Safaris may update these Terms and Conditions from time to time to reflect changes in its services, operational practices, or legal requirements.

The version applicable to a confirmed booking will generally be the version agreed at the time of booking, together with any later changes accepted in writing or required by applicable law.

Any material change to an existing booking will be communicated to the affected client where reasonably practicable.

25. Severability

This section explains what happens if a provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable. The remaining provisions will continue to apply to the extent permitted by law. Any invalid provision will be interpreted or limited only as far as legally necessary where that is possible.

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
